Can I legally use a pink ribbon?
I want to use a pink ribbon in my coupon book. I think it will help my sales, and i will be donating a portion of my profits to breast cancer research. I contacted the Nation Breast Cancer Foundation (NBCF), and the want $2500 up front and a % of my sales.
The NBCF symbol is not a pink ribbon, and I can not find if anybody legally owns the symbol. Anybody got any advice?
Ed Atun is right. The pink ribbon symbol itself does not belong to any single individual or organization, and don’t let anyone tell you so. Don’t pay anyone any money that says they do own it.
However, a certain version or logo designed with the ribbon may be the property of an organization. An example would be like one you would find on the Komen web site. We’ve already checked in to copywriting logos or phrases and it costs about $25 to have it regisitered here in Ohio.
Also, I’m not sure what terms of a partnership or affiliation agreement you discussed with NBCF, but they do have the right to require that any company/organization pay them a fee or whatever to be officially associated with them of have a corporate partnership like those between them and say Pepsi or Wal-Mart. It’s like a franchising fee.
Our company plans on donating to various charities also, but we don’t intend on partnering or paying any commissions just to be able to donate to them. If it’s required, we’ll find someone else who will appreciate the donations. We’re going to donate the funds through the charity’s web site or through another secure service like PayPal. We suggest you do the same.
The safest thing to do would be to have an artistic friend draw it for you (black ink on white paper), scan it into your computer, then color it yourself with MS Paint.
